Website Design Terms and Conditions

  1. Services: We provide website design and development services as specified in our project proposal.

  2. Payment:

    1. Initial Terms: As outlined in our project proposal. Projects begin after we receive acceptance of the quote, the required deposit, and all necessary content.

    2. Late Payments: May result in suspension of services or incur additional fees.

    3. Deposit and Balance: A deposit is mandatory to commence the project. The remaining balance is due within 3 days of the website going live.

    4. Method: Payments should be made via bank transfer. Please use your quote number or Organisation as a payment reference.

    5. Invoicing: An invoice will be issued upon receipt of the deposit. This invoice will detail both the deposit and the remaining balance, which is payable within 3 days of the site launch.

  3. Onboarding: An interview will be scheduled online using Zoom or Google Meet following payment confirmation. We are excited to start working with you.

  4. Digital Strategy Exploration & Consultation: if you have booked a Digital Strategy session online a deposit will not be required for us to commence your website project and 50% of the session fee will be credited towards your final website invoice if you proceed with us.

  5. Work Scope: Work is quoted as a flat fee for the maximum hours noted in the estimate. Additional time is billed at our standard hourly rate for web design subject to written agreement.

  6. Hourly Rate: our standard hourly rate for Digital Strategy & Consultation, including training and web design, is $180/hour (inc. GST). Our standard hourly rate for technical support, including doman names, email issues, and Google Workspace issues, is $120/hour (inc. GST).

  7. Client Responsibilities: Clients are responsible for timely provision of all required content (text, images, style guides, branding, etc.) and must own or have usage rights for all provided materials.

  8. Ownership: Full payment transfers website design and code ownership to the client. However, original materials like templates, custom code, 3rd party software integration, or stock photos remain the property of their respective owners.

  9. Revisions and Approval: Design revisions are limited as per the project proposal. Written (email) approval is required for the final website to go live. Once the website is approved to go live changes and revisons are additional charged at our hourly rate.

  10. Completion Timeline: We aim to meet agreed deadlines. Delays caused by client actions may lead to timeline adjustments. Project start date is set upon receipt of quote acceptance, deposit payment, and content.

  11. Handover & Training: We offer one hour of complimentary online training within 2 weeks of your website launch, unless specified otherwise in your quote. We may extend this period at our discretion. Any additional support or training beyond this will be billed at our standard hourly rate.

  12. Liability: We hold no liability for any business losses, interruptions, or indirect consequences resulting from website usage. Clients assume full responsibility.

  13. Copyright Indemnity: You guarantee the lawful use of all provided brands, photos, and text, indemnifying Online is Easy against any copyright claims.

  14. Maintenance, Updates and Training: Offered under a separate agreement post-launch.

  15. Termination: Either party may terminate with written notice. All financial commitments incurred before termination remain applicable and due.

  16. Governing Law: These terms and conditions are governed by the laws of Victoria, Australia.

  17. Amendments: We may update these terms from time to time at our discretion. Any changes will be posted online at www.onlineiseasy.com.au/webdesign-terms and take effect immediately. Your continued use of our services after any changes signifies your acceptance of the updated terms.
